Vertical Hydroponic Growing Systems

COVERED BY THIS LIMITED WARRANTY:

HYDRO-STACKER™ LLC warrants the original purchaser and not any other purchaser, or subsequent owner, that its HYDRO-STACKER™ LLC Hydroponic Growing System, polystyrene parts only, are free from defects in material or workmanship. No other parts or materials are covered by this warranty. The Lifetime Limited Warranty applies only to living entities. Non-living entities shall include but not be limited to governments, municipalities, corporations, and commercial operations. All non-living entities shall receive a 30-year limited warranty from the date of purchase. This Limited Warranty applies only to systems constructed entirely of components manufactured and/or supplied by HYDRO-STACKER™ LLC and is conditional upon the exclusive use of HYDRO-STACKER™ LLC supplied nutrient "A" & "B", growing media and any spray materials for insects, fungus, herbicides. Use of any none supplied or unauthorized nutrients, sprays, growing media (soil & etc.) or chemicals will void this warranty. All unauthorized sprays, nutrient or growing materials must be authorized for use by HYDRO-STACKER™ LLC before being applied or used on or around supplied equipment.

Should your HYDRO-STACKER™ LLC Hydroponic Growing System, polystyrene parts only, not conform to this Limited Warranty, HYDRO-STACKER™ LLC will repair or replace the nonconforming component of the system, or refund an amount equal to the replacement component, at the sole option of HYDRO-STACKER™ LLC, which remedy is exclusive.

NOT COVERED BY THIS LIMITED WARRANTY: (Commercial and Home Use)

Damage from abnormal or improper use or design, accident, neglect, abuse, abrasion, air pollutants, transport, storage, handling of the product(s) prior to installation, improper service or installation, or damage caused by flood, fire or act of God is not covered by this limited warranty. Use in harsh industrial environments is not warranted.

This limited warranty does not apply to any nonconformity in portions of piping, posts, or other system component improperly altered for installation.

Please note that the pump for the HYDRO-STACKER™ LLC home unit is a submersible pump and should not be run without being fully submerged in water when operating, Failure to operate pump fully submerged will void its warranty. The pump’s warranty is for a period of 6 months from purchase date. The timer for your unit should be set properly before starting to use the pump. The timer’s warranty is for a period of 6 months from purchase date.

PROTECTING YOUR RIGHTS:

To protect your rights under this warranty, your dealer will complete a warranty registration card and send it to HYDRO-STACKER™ LLC, with the certification of your dealer, within 30 days of purchase. Warranty coverage is not conditional upon the return of the warranty registration form, provided you can furnish proof that the HYDRO-STACKER™ LLC Hydroponic Growing System was supplied by HYDRO-STACKER™ LLC and meets all of the requirements. A properly filled out warranty registration form, completed by you and your dealer, is your best proof of coverage under this limited warranty.

GENERAL CONDITIONS AND EXCLUSIONS:

YOUR REMEDY UNDER THIS LIMITED WARRANTY WILL NOT INCLUDE LABOR TO REMOVE NONCONFORMING COMPONENTS OR TO INSTALL THE REPLACEMENT COMPONENTS, DELIVERY CHARGES, SALES TAX OR ANY OTHER CHARGES, NOR IS HYDRO-STACKER LLC REQUIRED TO PROVIDE SUCH LABOR OR SERVICE OR FOR OTHER CONSEQUENTIAL OR INCIDENTIAL DAMAGES.

THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES. HYDRO-STACKER LLC MAKES NO OTHER EXPRESS WARRANTIES, AND DOES NOT AUTHORIZE ANY OTHER PERSON OR AGENT TO MAKE ANY OTHER EXPRESS WARRANTIES. HYDRO-STACKER™ LLC NEITHER ASSUMES NOR AUTHORIZES ANY OTHER LIABILITY OR OBLIGATION IN CONNECTION WITH THIS PRODUCT. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ANY IMPLIED WARRANTY, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THIS PRODUCT, IS LIMITED IN DURATION TO THE TERM OF THIS LIMITED WARRANTY. IN NO EVENT SHALL HYDROSTACKER™ LLC BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES ARISING OUT OF OR CONNECTED WITH THE PURCHASE OR USE OF THIS PRODUCT OR FOR ANY BREACH OF WARRANTY.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE. THIS WARRANTY IS APPLICABLE ONLY TO SYSTEMS INSTALLED WITHIN THE CONTINENTAL UNITED STATES AND CANADA.
